More than 35 000 expressions of interest have been invited by the Department of Home Affairs for the 189 and 491 Family streams in December 2022. It came after two waves of invites, totalling more than 20,000, in October and August of the previous year. Furthermore, each state government is allowed a certain number of invitations to submit applications for subclasses 190 and 491. For instance, in October, November, and December 2022, Western Australia held three massive invitation rounds, totalling more than 15,000 invitations for subclasses 190 and 491.

Everyone is trying to meet the entry requirements for the expression of interest and is awaiting an invitation from the state government and the Department of Home Affairs, which is evidently the most popular visa application for general skilled migration.

The requirements to have a valid expression of interest is:
– a valid skill assessment
– evidence of a valid competent English (i.e: IELTS, PTE, etc)
– have 65 points in total

The first and most important step to enter the general skilled migration pool is to obtain a positive skill assessment. There are different skill assessment authorities handling the processing of skill assessment applications.
TRA and Vetassess is handling trade skill assessments.

Trade occupations such as Chef, Cook, Carpenter, Cabinetmaker, Gardener, etc can apply for a skill assessment through TRA or Vetassess.

TRA has recently changed their policy in Nov 2022. The new policy states the requirement to apply for a Migration Skill Assessment ( MSA ) is:

1- having a qualification comparable to AQF qualification – this includes RPL ( Recognition Prior Learning ) qualification obtained through work experience

2- You are required to demonstrate 3 years of full-time or equivalent part-time paid employment. This employment must be directly relevant to your occupation and can be completed any time in your work history.

3- To ensure your skills are current to Australian industry standards, your evidence must demonstrate you have worked for 12 months full-time (38 hours per week), or the equivalent part-time in your nominated or directly related occupation within the last three years prior to applying to TRA.

The employment can be self-employed or employed with an employer done in Australia or overseas.

First case study
"John has two years of full-time cabinetmaking experience in South Africa. He entered Australia in 2020 on a student visa and has been working part-time in the cabinet-making industry ever since. He lacks any qualifications that are pertinent to cabinet making. He wants to submit a skilled visa application."

Answer: He can, yes. Since he has three years of full-time work experience and his skills are up to date, he is eligible to apply for a skill assessment as a cabinetmaker and obtain an RPL qualification in cabinet making field.

Second case study
"Mary has earned her Certificate III in Commercial Cookery and is currently enrolled in Australia to earn her Certificate IV in Commercial Cookery, which she will accomplish in the following two months. She worked as a chef in a casual part-time capacity from July 2018 to July 2021. Since July 2021, she has been employed full-time due to the work restriction relaxation in Covid period. Once she has finished her CIV qualification, will she be able to get the skill assessment in Chef occupation?"

Answer: Yes, after she completes her CIV-commercial cooking course. She has three years of full-time employment and her skills are up to date.

Expedited citizenship pathway

From 1 January 2023, New Zealand stream Skilled Independent (subclass 189) visa holders who have previously held a Special Category (subclass 444) visa will have the commencement of their permanent residence period for Australian citizenship purposes backdated to 1 January 2022. This also applies to their New Zealand citizen family members who hold a Skilled Independent (subclass 189) visa. The backdating of permanent residence that has been announced means that, from 1 January 2023, New Zealanders that hold an Australian permanent residency are eligible to apply for Australian citizenship by conferral immediately following the visa grant, without needing to hold this visa for 12 months.
