Case scenario 1)
Applicant holds a 482 visa as a Café or restaurant manager which is on short term list. He seeks advice how to get permanent residency.
Advice) since the nominated occupation is on STSOL, there is no pathway to permanent residency from 482 visa, hence applicant should be assessed for a different type of visa such as 494 , 190 or 491 or Business visa 188 subject to meeting the requirements.
Case scenario 2)
Applicant holds a student visa and has studied CIII and CIV in commercial cookery. What would be the option to apply for PR?
Advice: if applicant has studied for two years can apply for Graduate visa work stream. The next step is to apply for JRP and complete work experience. Upon completion of JRP and obtaining a positive skill assessment may have the option to apply for a skilled visa. Alternatively, applicant may be able to apply for an employer sponsored visa ( i.e: 482) if sponsorship is available through a company.
Case scenario 3)
Applicant’s Graduate visa application has been refused and the review application is pending in AAT. Can he apply for a visa in Australia?
Advice: yes, he can. The applicant can apply for 494, 190 and 491 visas even though section 48 bar is applicable. It means applicant should complete JRP program and obtain skill assessment to apply for 491 or 190. If a sponsor company is available can also apply for 494 subject to meeting the requirements.
